Terms of Service
The rules for using OwnSender — what we provide, what you are responsible for, and the limits of both.
Table of Contents
Acceptance of these terms
These terms govern your use of OwnSender. By creating an account or using the service you agree to them. If you do not agree, do not use the service.
If you are agreeing on behalf of a company, you confirm you have the authority to bind it, and “you” means that company.
The service is provided by [Registered entity name].
Eligibility
To use OwnSender you must:
- Be old enough to enter a binding contract where you live, and have the legal capacity to do so.
- Provide accurate registration details and a working email address.
- Not be barred from using the service under applicable law.
OwnSender is a business tool. It is not intended for personal use by children.
Account responsibilities
You are responsible for:
- Keeping your password and any API keys confidential. Anyone holding them can act as you.
- Everything done under your account, including by members you invite and by anything you build against the API.
- The roles you grant. A member's role determines what they can see and send.
- Telling us promptly if you believe your account is compromised.
Verify your email address to activate the account. We may suspend an account we reasonably believe is compromised or is being used in breach of these terms.
Use of the service
Subject to these terms we grant you a non-exclusive, non-transferable right to use OwnSender for your own business purposes, for as long as your account is in good standing.
Your plan sets the limits — generated files per month, templates, projects, team members, dataset rows, storage, API keys and webhooks. Reaching a limit refuses the action that would exceed it; we do not bill overages. Plans and their limits are described on the pricing page.
You may not resell or sublicense the service, or provide it to third parties as your own product, without our written agreement.
Templates and content
Your content remains yours. Templates you design, copy you write, images and fonts you upload, and the files generated from them belong to you.
You grant us only the permission needed to run the service: to store your content, render it into files, and transmit those files to the recipients you choose. That permission ends when you delete the content or close the account.
You are responsible for having the rights to what you upload — including
- fonts you upload and the licence covering their use;
- images, logos and brand assets;
- text you did not write yourself.
Recipient data
The datasets you upload are yours, and you are the party responsible for them. By uploading recipient data you confirm that:
- You have a lawful basis to hold it and to email the people in it.
- You obtained it lawfully — not scraped, bought from a list broker, or taken without permission.
- You will honour unsubscribe and objection requests from those recipients.
- You will comply with the data-protection and marketing law that applies to you and to them.
We process that data on your instruction only. How we handle it is set out in the Privacy Policy.
Sending responsibilities
Your campaigns are sent from your own connected mailbox, not from an OwnSender address. That has a consequence worth stating plainly: the sending reputation, the replies, and any complaints attach to your account and domain.
You are therefore responsible for:
- The content of every message and document you send.
- Whether your recipients agreed to hear from you, and including whatever identification or opt-out your law requires.
- Staying within the sending limits your email provider imposes. Those limits are set by them, not by us.
- The consequences if a provider throttles, suspends or blocks your account for how you used it.
OwnSender gives you pacing controls — batch size, delays between messages and between batches — but it cannot and does not guarantee that a message reaches an inbox rather than a spam folder. That decision belongs to the receiving server.
Email provider integrations
Connecting Gmail, Outlook or an SMTP service authorises OwnSender to send on your behalf through that account. You remain bound by that provider's own terms, and nothing here overrides them.
A provider may revoke access, change its API, expire a token or impose new limits at any time. When that happens sending through that account will stop until you reconnect it. We are not responsible for a provider's decisions about your account.
You may disconnect a sending account at any time, which removes the stored credential and stops future sends through it.
Prohibited use
You must not use OwnSender to:
- Send unsolicited bulk email to people who did not agree to receive it.
- Send phishing, fraudulent, deceptive or impersonating messages, including documents made to look like they came from someone else.
- Distribute malware, or attachments intended to compromise a recipient.
- Harass, threaten, defame or incite violence against anyone.
- Send content that is unlawful where you or your recipients are.
- Infringe anyone's copyright, trade mark or other rights.
- Forge headers or otherwise disguise the true origin of a message.
- Circumvent plan limits, quotas or access controls, or probe the service for vulnerabilities without permission.
- Interfere with the service's operation, or with other customers' use of it.
We may suspend or terminate an account for a breach of this section. Where the breach is serious we may do so without notice.
Intellectual property
OwnSender — the software, its interface, its name and its branding — belongs to us and our licensors. These terms grant you the right to use the service, not any ownership of it.
You may not copy, decompile or reverse-engineer the service, or use our name or branding to suggest an endorsement or partnership that does not exist.
Feedback you send us may be used to improve the product without obligation to you, though we will not identify you as its source without asking.
Third-party services
The service depends on external providers for email delivery, payment processing and hosting. Those services operate under their own terms and we do not control them.
Where a third party's failure interrupts the service, we will act reasonably to restore it, but we are not liable for their acts or omissions.
Availability
We aim to keep OwnSender available and to give notice of planned maintenance where we reasonably can.
We do not offer a guaranteed uptime commitment. The service may be unavailable because of maintenance, a fault, a third-party outage or something outside our control. If you need a contractual availability guarantee, talk to us before relying on the service for something time-critical.
Service limitations
Some limits are inherent to how the product works, and you should know them:
- A campaign starts when you send it. There is no calendar scheduler and no recurring campaign.
- “Sent” records that the receiving mail server accepted the message. It is not proof of delivery.
- Bounces, opens and clicks are not tracked. Bounce notices go to your own connected mailbox.
- Generated files can be PDF, PNG, JPG, WebP or SVG. No other format is produced.
- Attachment size is bounded by what your email provider accepts.
We may change or discontinue features. Where a change materially reduces what you paid for, we will tell account holders.
Termination
You may stop using OwnSender and close your account at any time. What happens to a paid period is set out in the Refund & Cancellation Policy.
We may suspend or terminate your account if you breach these terms, if your use puts the service or other customers at risk, or if we are required to by law.
On termination your right to use the service ends. Export anything you want to keep before closing the account.
Disclaimers
The service is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We specifically do not warrant that:
- the service will be uninterrupted or error-free;
- a message will reach a recipient's inbox, or reach them at all;
- an email provider will continue to accept your sending volume;
- the service meets a regulatory requirement that applies to your business.
Nothing here excludes liability that cannot lawfully be excluded.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost profits, revenue, goodwill or data, arising from your use of the service.
Where liability cannot be excluded, our total liability is limited to the amount you paid us in the twelve months before the claim arose.
This section does not limit liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Changes to these terms
We may update these terms as the service changes. The date at the top of the page shows the last revision.
For material changes we will notify account holders, and continuing to use the service after a change takes effect means you accept it. If you do not, close your account.
Governing law
These terms are governed by the law of [Governing jurisdiction to be confirmed], and disputes will be subject to the courts of that jurisdiction.
Nothing in this clause removes a consumer protection you have under the law of the country where you live, where that protection cannot be contracted out of.
